Service of Legal Process & Fee Chart

Legal process is defined as any item of civil or criminal process, whether original, intermediate, or final
 that is valid on its face and is to be served or executed by this Office.

Classifications of legal process are defined as follows:

a) Civil Arrest is made pursuant to a written order by a judge of a competent jurisdiction in a civil action
or proceeding.

b) Civil Process is defined as those writs, summonses, mandates, or other process issuing from a court of
 law or equity pertaining to a cause of action of a civil nature and involving civil litigants.

c) Criminal Process is defined as those writs, summonses, mandates, warrants, or other process issuing
 from a court of law compelling a person to answer for a criminal offense.

d) Service is the delivery of any item of civil process that is completed with the act of delivery and doe
s not require physical or legal seizure of a person or thing.

Service include:

1) In Hand - (Personal Service) - the document is served to the person(s) appearing on the process, only.

2) Abode Service - can only be left at the residence given on the document. Any other location of the
person to be served must be given In Hand.

3) Corporation Service - left with an officer or registered agent of the corporation.

NOTE: A fee of $1.00 for postage will be charged for each writ or document to be served. Example: writ
of summons service fee = $15.00; postage = $1.00; travel to Franklin, NH = $19.50; total cost of service
$35.50. Other fees may apply as when making search, taking inventory, conducting a Sheriff's sale, or
waiting time at $15.00 per hour.


STATE SERVICE OF CIVIL PROCESS

RSA 510:4: Service on an individual, company or corporation residing out of state. The service must be
accompanied with a ten dollar ($10.00) recording fee made payable to the Secretary of State. Fee is charged
per writ, per defendant.

RSA 282-A:153: Service made on the Secretary of State pertaining to the Unemployment Compensation Statute.
No recording fee.

RSA 382-A: Unified Commercial Code Filing (U.C.C.). This service is the recording of a Writ of Attachment
(Bulky Article Attachment). A four dollar ($4.00) per page recording fee is charged. This service must be
stamped with the time from the U.C.C. office.

RSA 260:68: Service on the Division of Motor Vehicles; paperwork would consist of an individual residing
out of state involved in an accident which occurred in this state. A two dollar ($2.00) recording fee is charged.
This service must be time stamped from the DMV. Checks should be made payable to the Division of Motor
Vehicles.

RSA 405:10: Service made on the Insurance Commissioner or on an insurance company doing business in the
state, but not having an agent in this state to accept service. A twenty-five dollar ($25.00) recording fee is
charged, made payable to the Insurance Commissioner.

RSA 300-11: Service made on C.T. Corporation and/or Prentice-Hall as special agents designated to accept
service for various companies. No recording fee.

NOTE: Recording fee is separate from the fee charged for document service.


LEGAL PROCESS SERVICE - MILEAGE CHART AND COSTS:

An additional cost associated with the service of legal process is assessed for travel. This cost is separate
from the fee charged for document service.
